    Guys,

during our meeting with the lobbyists in Washington D.C. one thing stood clear. We have to get our employers in the big picture and we need to meet the lawmakers. For this we are going to start this effort Meet the lawmakers. The material and corresponding will eventually come from the Lobbying firm. But in the mean time we need to build the team. Immigrationvoice Board of directors has given me the responsibility to build this specific team. Those who have will to give their best to this task Please contact me on black_logs@yahoo.com well get started here.

    Thanks

There is no 6-year H1B visa. There is only 3-year H1B visa that can be renewed again for a total of 6-years stay on US soil. If you have spent 5 years on US soil and your tourist visa visits add ip to say 5 months, you still have 7 months on your H1B term. Even if you get a new visa it will be only for 7-months validity. Sometimes, USCIS makes a mistake and issues new 3-year visa but that is a gamble. Why not just stay off-US soild for a few months?

I left the US for good after spending around 5 years on H1-B sometime last year and have only made entries on tourist visa. Can I apply for a new 6 year H1-B quota since leaving the H1-B status last year or will I have to spend 1 year outside since the last tourist visa entry ?

Is there any law that prohibits termination of a worker during her PREGNANCY DISABILITY LEAVE (MATERNITY LEAVE) Or FMLA (Family and Medical Leave) on the basis that the USCIS didn't approve the petition (god forbid)?

Firstly, very sorry for your situation. Seems to be very tricky. I am no lawyer so take my .2 cents with a pinch of salt. I think you are intertwining two separate issues. FMLA may protect you during maternity leave (you need to read the act to see if you qualify) BUT USCIS not approving your petition has nothing to do with your pregnancy neither does your employer. Your employer can terminate you on the basis of non-approval of your H1 not that he is doing because of your pregnancy.

Immigration Voice has been featured today's Baltimore Sun Headlines. Given that many of the Lawmakers and their Staff reside in the Baltimore area, we're sure that this will be a great positive impact for our cause. Thanks to our member Raj Patel for volunteering for this effort.

Agree. I bought a better beamer just for that. I've only used it a few times with mixed results. Definitely worth the practice to get it right.

Well I've run a test shooting one subject with my D70 on each available white balance setting and uploaded the results to the gallery (sorry for taking up space but curiosity was killing me). Turns out the gallery read my EXIF data correctly on 2 out of the 6 pics uploaded, "Incandescent" & "Cloudy". All others read cloudy, so I'm not sure if the discrepancy is with the camera or the gallery. When I read the data on my PC they all read "manual white balance" so that's no help. Anyway, the following links contain the results:

and the write-up mostly talks about illegal immigration.

While quoting, discussing such links helps the members of this forum somewhat in keeping the buzz, I feel we must have focussed efforts on specific provisions that will improve the issues faced by legal immigrants. It is possible that this is easier to achieve than a Comprehensive Immigration Reform that this articles speaks about. Thanks to apnair2002 for the post.

    Thanks for the reply.

Where does 1099 fit in in the above list?

Are there any benefits of one over the other?

Yeah, right, first u need to find out which 140 was withdrawn. If the approved one is withdrawn, u r safe based on the fact that the same 140 was used with 485.

    Hi..
I came to US on H4. My H1B got approved when i was in India. But I came through H4 only.
Now i want to change H4 to H1B. If i want to apply for change of status..do i need to go back to india(ot other countries) for stamping? Or can i get H1B staying here?
    Please help..

Currently you are on H4. If you apply for H4 to H1 transfer, you can get H1 and start working from October this year. If you cannot find project immediately, you wait up to 3 months or 6 month (maximum), otherwise change status back to H4 or you will be in trouble. Since economy is not good, it is tough to get projects nowadays, already current H1 holders are looking for projects and some have gone back. if you have already worked in India, then you may get project easily, If you did not work, then it is tough to get a project. When you are on H4, you can have peaceful life while your psouse is working, you can have get togethers whenever you want, you can cook special dishes for your spouse and wait at the door in the evenings.Real problem arises when you become pregnant (assuming you are woman), you need to take a long break if you are working,, especially if you are away from your spouse....so point is have fun with spouse, have get togethers with other couples, go shopping at BedBathandBeyond/walmart/target/jcpenny in discount seasons, have honeymoon trips again n again...Go to India whenever you want. These things are so memorable than struggling to get projects and maintaining status. When you cant maintain status you cannot go to India whenever you want....
Just want to let you know the real picture...when H4 wants a H1.

Labor substitution is not an option anymore. I have PD Dec 2002 EB3 India working on EAD.
I am trying to pursue EB3 to EB2 porting. Risky but possible technically.

I have applied for my extension of H1B at Vermont Center. my first three years on H1b expired on Sep 8th. The application was filed on July 20th and it is normal processing. I have my H1b and H4 receipts with me, but its not yet approved. I am planning to take B1 visa appointment for my mother. Shall i send my mother to B1 stamping with H1B receipt.

Does Chennai consulate will accept H1b receipt for Visitor Visa or Shall we wait for H1b Approval? thanks in Advance....

    thanks,
    Sreenuk

What I was wondering was that, since BOTH F-1 and TN are non dual-intent visas, would they allow people to hold both of them at the same time? So that I can study during the school year, and work in the same area in the summer instead of having to go back home to support myself.

You can stay here as long as the I797 is valid (there is no rule to stamp it within a year). Do you have H1B stamped frome before or is this your first H1? If the first one then you have to get it stamped when you travel out of US. If this is not the first one then you can travel back on your old H1 stamp with new I797.
