You will not jeopardize your I-485 as long as job with company C is in same or similar occupation. Whether USCIS will grant an H-1 3 year extension based on a withdrawn/revoked I-140 is not certain. I outlined the reasons for this uncertainty in my response on the thread entitled "Facing Layoff---6 months left..."

I'll give you a honest answer. Consult an attorney and find a fool proof step, if there is one. Although, I'm inclined to say, stay F1 and bring her as F4. You need much more than that.

Do any of you received finger prints notice who has E-Filed EAD renewal between June 25th - June 30th.
We filed on June 29th with Texas Service Center and it's been a month we are waiting for FP notice.
I appreciate ur help.

I did about 3 APs and EADs myself this is not so important. I had left it blank. The most important thing I remember is my EAD got rejected was when I picked the wrong section for the Basis of EAD (which is a bunch of codes). Please make sure you pick the right one here, if your in doubt dont fill the form till you know the exact answer.

I am planning to visit Canada sometime in the summer, and being Indian, I need a visitor's visa.
The Canadian consulate doesn't have much information about Advance Parole holders in the US applying for a visitor's visa, and it looks like the process is the same as for F-1, H-1B holders.
I am wondering if I need to send the original AP (as a supporting document) or if a copy will do.
I can't go to the consulate in person, and have to send my stuff in the mail, or this wouldn't have been an issue.

I believe what you need to show is the company's P&L statement with revenue statement, and not just $7000 in profit. if the company has a revenue of $1mil or more, it should be fine, if less then it needs to show how many employees it had and what profit or loss it made....it should be at least $1.0 profit, rather than a loss.

I have 5 year bachelors degree from India and 3 years of work experience. I am in to Health sector.
My question is I got my education credentials evaluated last year for H1B filing. but I missed last year's H1B quota and applying again this year.
Do my last years evaluation report is scuffiscient or do I need fresh evaluation of my education credentials?
How long the education evaluation report is valid Once evaluated?

One must accept a Temporary Protected Status (TPS) beneficiary's expired Employment Authorization Document (EAD) if DHS has automatically extended its validity in a Federal Register notice. Automatically extended EADs are listed on the USCIS web site. My application for an H1B change of status has been denied. I am an F-1 student from Colombia and I was offered a job from THe CDC at Atlanta. According with the USCIS report, the petition was denied because I am going to be hired for a staffing company and not directly for the CDC. It will be possible to appeal the desicion ? If yes, what will my sponsor company need to be succesful with this appealing ?

Me and my wife filed H1B extension through a company. I moved to consulting after my extension is approved. The consulting company filed my H1B transfer which is approved recently. Unfortunately my employer (the consulting company I moved to) dint file for my wife's H4 extension and he told that was not needed.
My question is can my wife with the petition approved from my previous employer to get her H4 stamped in India?
